Manitoba Government Introduces Legislation that would Assist Targets of Vexatious Registrations, Protect Citizens

Proposed Rules would Simplify Getting Rid of False Liens: Minister Lemieux

The Manitoba government introduced the personal property security amendment act today, which would provide a streamlined, fair approach to safeguard people from harassment through the false or vexatious registration of a lien through the Personal Property Registry, Tourism, Culture, Heritage, Sport and Consumer Protection Minister Ron Lemieux announced today.

“The vast majority of registrations with the Personal Property Registry are legitimate documents, representing a mutually agreed guarantee of someone’s personal property in return for credit,” Minister Lemieux said.  “However, there is a growing problem of harassment through frivolous or vexatious registrations with no legitimate basis and this legislation would address that.”

Victims of vexatious registrations often only find out about these types of registrations when they have difficulty securing credit or conducting some kind of property-related transaction.  Currently, victims of these registrations must go to court to have the registrations removed, which can be costly and time consuming, the minister said.

Under this proposed legislation, the registrar would be able to review these matters and remove vexatious registrations without the victim having to pay a lawyer and without taking up valuable court time, Minister Lemieux said.
