New Legislation Protects Manitobans by Providing Safer Liquor and Cannabis Delivery

Legislation Responds to Concerns about Third-Party Delivery Companies: Friesen

The Manitoba government has proclaimed the Liquor, Gaming and Cannabis Control Amendment Act that holds third-party delivery companies responsible for regulated products, Justice Minister Cameron Friesen announced today.

“Our government was proud to bring changes that shift the responsibility from restaurants and retailers to third-party delivery companies when it comes to the delivery of liquor and cannabis,” said Friesen. “The delivery industry is growing and we are ensuring that Manitobans have protections whenever and wherever liquor and cannabis products are delivered for consumers.” 

Friesen noted a new licence category under the Liquor, Gaming and Cannabis Control Act would now authorize third-party companies to deliver liquor and cannabis products to customers on behalf of retailers and restaurants. Previously in the event of non-compliance with requirements, the liability was on the restaurant, lounge or retailer who used the third-party delivery company and not the third-party delivery company.

Legislative changes also enable the Liquor, Gaming and Cannabis Authority (LGCA) to develop a minor agent program that will enhance its capacity to enforce breaches related to selling or serving regulated products to minors and young people. Agents under the program would attempt to purchase regulated products and allow the LGCA to monitor licensees’ compliance with prohibitions on under-age sales. All minor agents are required to work with an LGCA inspector at all times.

The minister noted the minor agents program has been successful in other jurisdictions and is aligned with public health and safety policies that strive to minimize the availability of these products to minors and young persons.

Following the passage of Bill 60 on May 20, 2021, a 45-day public consultation period was held.

These regulations come into effect today.
