Statement from Justice Minister Kelvin Goertzen on Manitoba Court of Appeal Ruling in University of Manitoba Faculty Association Case



The Manitoba government fully respects the July 13 decision of the Manitoba Court of Appeal in the University of Manitoba Faculty Association (UMFA) remedy case. After careful review by its constitutional law branch, the Manitoba government will not be seeking leave to appeal the case to the Supreme Court of Canada.

Receiving the benefit of consideration from our highest court was in the interest of all Manitobans. Especially following the Court of Appeal’s October 2021 comprehensive decision on the main constitutional issues in the broader Manitoba Federation of Labour case, in which the Manitoba government was entirely successful.

On the now concluded and much narrower UMFA aspects of the case that involved events which occurred in 2016, Premier Heather Stefanson has strongly signalled that it is time to turn the page for the benefit of UMFA members and all Manitobans.
