Standing Hearing for Inquest into Deaths of Clinton Mcgeough, Dwayne Simard, David Midouin



A standing hearing will take place to determine who can participate in the upcoming inquest into the deaths of:

  • Clinton McGeough of Stony Mountain (date of birth Aug. 8, 1981);
  • Dwayne Simard of Stony Mountain (date of birth Aug. 11, 1983); and
  • David Midouin of Stony Mountain (date of birth Nov. 28, 1992).

The circumstances of death were as follows:

  • On July 9, 2021, McGeough was found deceased in his cell at Stony Mountain Institution during a routine check. Drug paraphernalia was identified within the cell. The cause of death was noted to be fentanyl toxicity.
  • On March 1, 2021, Simard was found unresponsive on the floor of his cell.  Attempts at resuscitation were unsuccessful. Two days earlier, Simard had been taken into custody and was transferred to Stony Mountain Institution 24 hours later.  It is reported that he advised Winnipeg Police that he was withdrawing from opiates. It is also reported that at Stony Mountain, he complained to staff of feeling unwell and told them he was withdrawing from opiates. A medical consultation was sought and it was decided Simard did not require any medication at that time.  An appointment was made to see a nurse practitioner the following day, which was the day of his death. The cause of death was a mixture of toxicity (fentanyl and methamphetamine).
  • On Aug. 28, 2021, Midouin was found dead in his cell. Apparent drug and drug paraphernalia were found in his cell. The cause of death was noted to be mixed drug toxicity (fentanyl and MDMA). 

Under the Fatality Inquiries Act, an inquest has been called by the chief medical examiner. Inquests explore the circumstances and events leading to deaths for the purpose of finding out what, if anything, might be done to prevent similar deaths in the future.

Before the inquest begins, the judge will decide who can participate in the process and question witnesses. Individuals and groups may make an application to be granted standing and participate in the inquest. The standing hearing will be held at 2 p.m. on Feb. 1, 2024, in courtroom 408 at the Manitoba Law Courts Complex, 408 York Ave., Winnipeg.
